Copyright and Trademark Traps: Don't Put Your POD Account at Risk

Copyright and Trademark Traps: Don't Put Your POD Account at Risk

In print-on-demand the fastest growth and the fastest collapse are both possible. Putting a film character, a brand logo or a song lyric on a design looks clever at first, until your shop is suspended overnight. Copyright and trademark rules are not the entrepreneur's enemy but their long-term protection. Knowing them makes you more professional than most of your competitors.

Copyright versus trademark

The two are often confused but differ. Copyright protects original creative works: drawings, photographs, lyrics, film scenes. A trademark protects the names, logos and slogans that identify a business. Copying a drawing of a character infringes copyright; putting a brand's name on your product infringes a trademark. Either can close your account.

Never touch

Stay well away from designs containing: famous film and series characters and quotes, sports team logos, bands and song lyrics, the logos and slogans of well-known brands, and the faces or signatures of famous people. "I changed it a little" is not a defence; similarity alone can be enough.

A business built on someone else's brand is a house built on a rented foundation. One day it comes down.

Check before you print

Before printing a trending phrase, search the trademark databases of the markets you sell in, such as the USPTO in the US. A phrase that sounds generic may still be registered for clothing.

Safe ground: original and general content

The safe and sustainable route is your own original designs and general themes. Typography-based phrases that do not belong to a brand, nature, hobbies, professions, humour and emotional messages are a wide and open space. A message like "Best Dog Mom" belongs to nobody and speaks to millions of people.

Licences for fonts and images

A point many sellers miss: the fonts and stock images you use also need a commercial licence. Not every "free" font is free for commercial use. Working from commercially licensed sources or your own creations shuts the door on future claims.

If in doubt, leave it out

One simple rule saves businesses: if you are not sure an element can be used, do not use it. The short-term gain from one design is not worth losing your account and the reputation you built over years. Respecting these rules is not a limit but solid ground you can build on with confidence.
